Refunds
If you cancel or postpone your event, 72 hours prior to the date of the event, BartenderGirl.Com will charge a cancellation fee. If you cancel or postpone your event less than 48 hours prior to the date of the event, you will be responsible for payment in full, for services used up to that day, example: Event insurance, Event Permit, Personal Shopper, Rental items, ordering beverages or food purchased.
IMPORTANT NOTE: You are responsible and will not get a refund, if we obtained , a certificate of insurance, permits or other reservations that required immediate or advance payments.
Your product shipment
Packages are generally dispatched within 2 days after receipt of payment and are shipped via UPS with tracking and drop-off without signature. If you prefer delivery by UPS Extra with required signature, an additional cost will be applied, so please contact us before choosing this method. Whichever shipment choice you make, we will provide you with a link to track your package online.
Shipping fees include handling and packing fees as well as postage costs. Handling fees are fixed, whereas transport fees vary according to total weight of the shipment. We advise you to group your items in one order. We cannot group two distinct orders placed separately, and shipping fees will apply to each of them. Your package will be dispatched at your own risk, but special care is taken to protect fragile objects.
Boxes are amply sized and your items are well-protected.
Please note that arrival time may be delayed due to road conditions, accidents, or unforeseen circumstances. BartenderGirl.com will ensure travel time is included to arrive on time, but we cannot be held responsible for the circumstances stated above.
The parties acknowledge and agree that a change to the services may result in an increase in the applicable service fee or invoice amount. In addition, the parties will mutually agree to changes to the services before they are incurred.
EXPENSES. In addition to the final invoice, Customer shall reimburse Bartendergirl for reasonable related expenses, provided that such expenses are actually incurred in connection with the rendering of the Services and any additional hours incurred during service or any chargeback.
GENDER PREFERENCE WHEN MAKING A RESERVATION
Substitutions & changes on gender preference: We reserve the right to make substitutions when the selected gender is unavailable. While every effort will be made to honor your request regarding staff gender, such a request is not guaranteed. Please note that gender preferences are not guaranteed
6. RELATIONSHIP OF PARTIES. It is understood by the parties that BartenderGirl is an independent contractor with respect to Customer, and not an employee of Customer. Customers will not provide fringe benefits, including health insurance benefits, paid vacation, or any other employee benefits for BartenderGirl; each staff member is an individual contractor for BartenderGirl, and each staff is responsible separately for any incident, complaints, or liabilities.
CONFIDENTIALITY. BartenderGirl will not, at any time or in any manner, either directly or indirectly, use for the personal benefit of BartenderGirl, or divulge, disclose, or communicate in any manner any information that is proprietary to Customer. BartenderGirl will protect such information and treat it as strictly confidential. This provision shall remain in effect after the termination of this Agreement. Upon termination of this Agreement, BartenderGirl will return to Customer all items that were used or controlled by BartenderGirl during the term of this Agreement.
LIABILITY. The customer acknowledges that it is his/her obligation to obtain appropriate insurance coverage for the event. Bartendergirl is not responsible for such insurance coverage.
LIMITATIONS ON LIABILITY. The Maximum Liability of Bartendergirl, its directors, officers, parent company, CATERING AND BEVERAGES SERVICES BARTENDER GIRL, Zerpa, Zerpa Calisthenics Foundation, Ben J. Zerpa and affiliates to the client for damages for any all causes whatsoever, and client's maximum remedy, regardless of the form of action, whether in contract, tort of otherwise, shall be limited to an amount equal to two times the total service fees paid ( $100.00 ) by client to Bartendergirl hereunder. In no event shall BartenderGirl its directors, officers, parent company, contractors and affiliates, licensors, CATERING AND BEVERAGES SERVICES BARTENDER GIRL, Zerpa, Calisthenics Zerpa Foundation, Square, Ben J. Zerpa and suppliers, be liable for any lost data, lost of any valuable item or content, lost profits, business interruptions or for any indirect, incidental, special, consequential, exemplary or punitive damages arising out or relating to the deliverables or the services provided hereunder, even if BartenderGirl. has been advised of the possibility of such damages, and notwithstanding the failure of the essential purpose of any limited remedy.
APPLICABLE LAW. The laws of the State of California shall govern this Agreement.
RENTAL POLICY. All charges are for time out, whether or not the time is used.
LOSS OR DAMAGE
Responsibility for the equipment remains with the customer from delivery until return. Please ensure the equipment is secured when not in use and protected from the elements. Replacement charges apply to missing, damaged, or broken items. Customers shall be liable for damages arising from our loss of rental items that are not returned during regular business hours.
DAMAGE WAIVER
A damage waiver may be purchased for 15% of your total order amount. It does not cover loss, international misuse, theft, cleaning charges, or mildew on linen. The damage waiver covers replacement charges for equipment resulting from accidental damage or breakage. You must furnish proof of breakage. Damage waiver does not cover the following rental equipment: Sound Systems, Dance Floors, or Karaoke Machines, Microphone or Music/Karaoke CDs
DELIVERY & PICK UP
An additional delivery fee is charged based on the location. Quotations are for first-floor locations. All equipment must be ready for pickup in a single location.
Tables and chairs should be folded and stacked, ready for pickup in a protected area. Linens should be free of food residue and dried to prevent staining and the growth of mildew. Do not place linens in plastic bags, as mildew may result. All china, silver, utensils, and similar items should be rinsed, free of food, and repacked in the delivered containers.
SET-UP & TAKE DOWN
Arrangements must be made in advance for setup and teardown, and will incur a fee.
DEPOSIT
A deposit is required when making a reservation for any staff services of $150.00 per staff, using a credit card such as Visa, Discover, American Express or MasterCard or 50%, 80%, 90% of the entire invoice this terms are usually specify in the original estimate and or invoice send before this contract A deposit is required to secure a reservation for any staff services. This deposit is set at $150.00 per staff member and must be paid by a major credit card (Visa, Discover, American Express, or MasterCard) or may constitute 50%, 80%, or 90% of the invoice amount. The applicable terms for the deposit percentage are typically specified in the original estimate and/or invoice provided prior to the execution of this contract.

WARNING
The use of false or fictitious identification to obtain the rental items, or the failure to return the rental items on the Agreed Return Date of this Rental Agreement, may constitute theft and may result in criminal prosecution. Your attention is directed to California Penal Code Section 484 and California Penal Code Section 476A
NO REFUND POLICY.
By using our services, you hereby authorize BartenderGirl to charge his/her credit card account for services rendered from BartenderGirl.Com You affirm he/she is at least 18 years old and that you are legally authorized to use the credit card, Zelle, PayPal or Venmo account number specified when the reservation was processed. Furthermore, you understands and agrees that the charges specified above, or any other charges, are irrevocable and may not be charged back at any time in the future.
You understand that if he/she cancels this event, there will be a cancellation fee of $550.00, and in some cases, additional fees will apply:
Bartenders, Bar-Back, Photo Girl, & Wait Services: $150.00 per staff member
Disc jockey's services are: $150.00
Valet service is: $200.00
Limo/Tow Car Services: $250.00
Personal Shopping Services: $179.00, plus any expenses incurred in purchasing your items.
Rentals: $100.00, plus a 10% restocking fee on the invoice.
Bar Rental: $35.00
Dance Instructor: $75.00 (Zumba, Salsa, Go-Go Dancer)
Insurance: $189
Permits: $255
Venue Licensing: $35
Live Band: Full Booking Fee and agreed payment.
Charge-Back Fee: $60.00 per incident if the client initiates a chargeback.
Chargeback Fee $45
Venue Licensing: $255

If there is a dispute regarding any of the services or rentals provided, and we issue a refund, the refund will be issued as a credit for future use on bartendergirl.com.
In the event of a dispute regarding any services or rentals provided, any refund shall be issued as a credit for future use on bartendergirl.com.
Charge Back Fee
$160.00 for any chargebacks or credit card disputes that are resolved in our favor.

17. The parties acknowledge and agree that a change to the services may cause an increase in the applicable service fee or invoice. In addition, the parties will mutually agree to changes to the services before they are incurred. If your event is outdoors after 7:00 PM, you must provide heating equipment to staff stationed outdoors. If the event is scheduled before 7:00 PM, you must provide cover if the weather is sunny. A modification to the scope of services may result in an increase to the applicable service fee or invoice, which the parties both acknowledge and accept.
All proposed changes to the services must be mutually agreed upon by the parties before any costs are incurred.
For outdoor events:
If the event extends past 7:00 PM, the client is responsible for providing heating equipment for staff stationed outdoors.
If the event is before 7:00 PM and the weather is sunny, the client must provide cover for staff stationed outdoors.
18. DISPUTES AND DISSATISFACTION WITH THE SERVICE
BartenderGirl reserves the right not to process any complaints containing abusive or foul language.
All disputes and complaints must be addressed and filed by the event staff during the event or at the end of the event; this ensures that we can properly resolve, address, or process any disputes, complaints, or other issues arising from the service provided to you. These issues may include failure to receive rentals or products, or problems with the service(s).
To ensure timely resolution, all disputes and complaints must be filed with the event staff during the event or immediately upon its conclusion. This enables us to properly address, resolve, or process any issues related to the services provided, including unreceived rentals or products, or any other service-related problems.
If a dispute is not addressed at the time of the service, at the completion of the service, or within 12 hours of the event, it will be deemed to have no issues or complaints. There is no cash refund, nor a credit card refund. Refunds are issued as service credits or rental credits for future events. Any disputes, issues, or complaints must be addressed either at the time of service completion or within 12 hours after the event concludes. Failure to report within this timeframe will be considered an acknowledgment that no issues or complaints exist.
Please note: We do not offer cash or credit card refunds. Refunds, when issued, will be provided in the form of service credit or rental credit for use at a future event.
19. DISPUTE NOT RESOLVED MUST BE PROCESSED BY THE BETTER BUSINESS BUREAU.
Please note: The Better Business Bureau's goal is to resolve complaints involving buyers and sellers fairly and in a timely manner. This includes complaints concerning consumer-to-business and business-to-business transactions involving the advertisement and/or sale of a product or service.
Better Business Bureaus generally do not handle complaints that are more effectively handled by other government or private agencies or the legal system, such as complaints involving employment practices, discrimination, or matters in litigation.
The BBB strongly encourages consumers to first attempt to resolve complaints directly with the company; however, the BBB will not reject a complaint if a consumer has not taken this step. All complaints are processed by local Better Business Bureaus, most often the Bureau where the company is located. Historically, more than 70% of complaints to the BBB have been resolved. In some cases, BBB mediation or arbitration may be offered to assist in resolution.
BartenderGirl, Inc., reserves the right not to process complaints containing abusive or foul language.
20. VERBAL ABUSE, UNETHICAL CONDUCT, OR HARASSMENT
BartenderGirl reserves the right not to provide services, stop providing services, stop service at any time during the course of the event, when BartenderGirl’s staff(s) believes that there are illegal activities on the premises, an unsafe situation such as fights, underage drinking, gang activity, parolees or convicted felons gathering, intoxicated abusive or aggressive guests and/or aggressive or abusive customer(s) and/or harassing guests and customers, customer or guest verbally abusing or harassing BartenderGirl staff, and any other activity that BartenderGirl will deemed as unsafe. You will be responsible for full payment of the event fee if any such situation occurs during the event.
Sales of beverages will be reported to the ABC (Alcohol Bureau Control of California) underage drinking will be reported to the police, regardless of the incident.
21. CONDITIONS AND ACKNOWLEDGEMENT FOR EVENTS WITH OR WITHOUT PERMITS AND/OR INSURANCE.
It's our job to practice responsibility and alcohol awareness:
1. IF NECESSARY, THE ASSIGNED BARTENDER(S) WILL ASK FOR PROOF OF LEGAL AGE TO ANYBODY WHO LOOKS YOUNGER THAN 21 YEARS OLD WHO WISHES TO DRINK.
2. THE ASSIGNED BARTENDER(S) WILL REFUSE ALCOHOL SERVICE TO ANYONE WHO, IN HIS/HER JUDGMENT, HAS HAD TOO MUCH TO DRINK.
3. SECURITY STAFF (IF ANY) WILL BE NOTIFIED THROUGHOUT THE COURSE OF THE EVENT OF PEOPLE WHO WE WOULD SUGGEST CUTTING OFF, SO YOU CAN TAKE PROPER ACTION.
4. WE WILL NOT SELL ANY ALCOHOL (COLLECT CASH/CASH BAR OR DONATIONS) FOR PROFIT FROM THE EVENT
5. WE WILL NOT COLLECT ANY PAYMENT FOR ALCOHOL. (COLLECT CASH/CASH BAR OR DONATIONS) FOR THE EVENT. BUT THERE IS AN OPTION TO CONVERT THE EVENT TO A CASH BAR IF NECESSARY.
6. WE WILL HAVE 1 BARTENDER STAFF FOR EVERY 200 GUESTS
7. YOU/WE WILL HAVE A MINIMUM OF TWO SECURITY GUARDS
8. YOU/WE WILL HAVE AN ID VERIFICATION MACHINE
9. CLIENT WILL NOT PROVIDE ALCOHOL
10. OPEN OR UNOPENED ALCOHOL CANNOT BE RETURNED
11. AFTER COMPLETION OF THE EVENT, CLIENT WILL SECURE AND REMOVE ALCOHOL FROM VENUE (If applicable)
